Article 1 - Scope

The present general terms and conditions of sale ("G.T.C.") govern the conditions under which the company Quartier Libre, a company governed by French law by simplified shares with a share capital of 4,000 euros, registered in the Paris Trade and Companies Register under number 887 741 924 and whose registered office is located in Paris (75116), 7 rue Leroux, 75116 Paris, France, ("Quartier Libre", "We", "Us", "Our") sells, and the consumer ("Customer") buys, the products and services offered by Quartier Libre ("Products") via the https site: //www. quartierlibreparis.com ("Site").

Quartier Libre reserves the right to adapt or modify at any time the present terms and conditions, the version of the GTC applicable to any transaction being the one appearing online on the Site at the time of the order. Consequently, the fact of placing an order implies full adherence, without reserve, to these conditions.
Subject to any provision contrary to the law, the GTC applicable to relations between Quartier Libre and the Client are those in force on the day of validation of the order. They apply to the exclusion of all other conditions. As Quartier Libre does not carry out any telephone canvassing, the provisions of the Consumer Code relating to telephone canvassing at home are therefore inapplicable to orders under these GTC.

Article 2 - Accessibility Site
​
The Site is accessible to all users of the internet network by principle 24/24h, 7/7d, except interruption, scheduled or not, by Quartier Libre or its service providers, for the needs of its maintenance and/or security or in case of force majeure. Quartier Libre cannot be held responsible for any damage, whatever its nature, resulting from the unavailability of the website.
Quartier Libre does not guarantee that the Site will be free of anomalies, errors or bugs, nor that the Site will operate without failure or interruption. In this respect, Quartier Libre can freely and at its sole discretion determine any period of unavailability of the Site or its content. Quartier Libre cannot be held responsible for problems of data transmission, connection or network unavailability.
Quartier Libre reserves the right to update the Site for technical or commercial reasons. When these modifications do not alter the conditions of the provision of services, substantially and negatively, the Customer may be informed of the modifications, but his acceptance is not requested.

Article 3 - Orders
​
Orders are placed on the Site as well as on the Sovereign Collective partner site. Connection and Internet access costs are at the Customer's expense.
The order taking on the website is subject to the respect of the procedure set up by Quartier Libre, which consists of a succession of different steps that the Client must follow to validate his order. Any order validated by the Client is worth contract of sale and acceptance without reserve of all the GTC.
At the end of the law, the process known as "double click" during the validation of the order, associated with the procedure of authentication and non-repudiation, as well as the protection of the integrity of the messages, constitutes an electronic signature, which has value between the parties in the same way as a handwritten signature. Unless proven otherwise, the data recorded by Quartier Libre constitute the proof of all transactions between Quartier Libre and the Customer.
A confirmation of the order validated by the Customer will be sent to him by e-mail prior to the dispatch of the order, and will make the final sale subject to the right to exercise the right of withdrawal. To this end, the Customer formally accepts the use of electronic mail for confirmation by Quartier Libre of the content of his order. The version of the GTC applicable to a given order may be kept by the Customer by computer recording or printing on paper.

Article 4 - Availability
​
The products offered for sale are those described on the Site on the day of the consultation of the site by the Internet user, within the limits of available stocks. The sales are concluded subject to the effective availability of the products.
In the event that a product ordered proves to be unavailable, for reasons independent of Quartier Libre, the Customer will be informed by e-mail. The order will be automatically cancelled and refunded within a maximum of 10 working days.
Quartier Libre takes the greatest care in the presentation and description of its products to best satisfy the Client's information. It is however possible that non-substantial errors may appear on the website, which the Client acknowledges and accepts.​
In any case, in case of non-conformity of the delivered product compared to its description on the website, the Client will be able either to exercise his right of retraction or to implement the guarantee of conformity of Quartier Libre which will proceed to the refund of the price (in whole or in part) possibly charged within a maximum period of 10 working days.

Article 5 - Price & Payment Terms
​
Quartier Libre reserves the right to modify its prices at any time. Note that the products will be billed on the basis of the rates in effect at the time of validation of the order by the Customer, based on availability.
The prices of the products are indicated in euros, all taxes included (VAT at the current rate) excluding participation in shipping costs and personalization (embroidery). These costs are made known to the Customer before the stage of validation of the order. The customs clearance, the payment of rights or various taxes are at your expense.
The products are payable on the day of the effective order. The products remain the property of Quartier Libre until full payment of the price.

The payment of purchases is made on the Site via our banking solution Stripe, by credit card (Carte Bleue, Mastercard, Visa and American Express). It benefits from PCI DSS level 1 certification, the highest level of security for internet payments, and is DSP2 compliant. The 3D Secure system also enables secure online payments thanks to its authentification procedure.
The card is debited when the order is validated.
The Customer expressly acknowledges that the communication of his credit card number to Quartier Libre is an authorization to debit his account up to the amount of the ordered products.

The data recorded and kept by Quartier Libre constitute the proof of the order and of all the transactions made. The data recorded by Stripe constitutes proof of financial transactions.

Article 6 - Delivery
​
The delivery times indicated are in working days. The deliveries are ensured by the services Colissimo and Mondial Relay from Monday to Saturday.
Delivery is made to the delivery address indicated by the Customer, it being specified that this must be the residential address of the Customer, a physical person of his choice or a legal entity (delivery to his company). The delivery to pick-up station is also available, you just need to choose the closest one to your address among our proposals.
Delivery times are 3 to 5 working days in France, 4 to 7 working days in Europe and the time is variable for the rest of the world.
In order for these deadlines to be respected, the Customer must ensure that he has provided accurate and complete information concerning the delivery address (such as : street, building, staircase number, access codes, names and/or intercom numbers, etc.).
The times indicated are indicative times, corresponding to the average processing and delivery times. Quartier Libre will not be held responsible for the consequences due to a delay in delivery that is not its fault.
In case of personalization of a product (embroidery) the shipping time can be extended from 4 to 8 working days.
To track the package, simply go to Colissimo or Mondial Relay website, click on "follow my package" and manually enter the tracking number.

In case of an unusually long delivery time or non-receipt of products ordered, the customer can contact customer service within 30 days by e-mail at bonjour@quartierlibreparis.com. An investigation will then be opened with La Poste in order to locate your package. The duration of this investigation may vary from 3 weeks to 1 month, depending on the period. If the package is found, it will be immediately reshipped to the address indicated at the time of the order. If the package is declared lost by La Poste, the products will be reshipped (within the limits of available stocks) or reimbursed. No refund or return of the products will be made before closure of the investigation.

Article 7 - Returns & Exchanges
​
Under Article L.121-20 and following. of the French Consumer Code, the Customer may request a refund of his articles within 14 days of receiving his order. The return of the product(s) are taken in charge by Quartier Libre for online orders, in Metropolitan France, by Colissimo, except for orders of personalized products (embroidery) which will not be refunded.
It is necessary to send an e-mail indicating the return request, the subject of the return and the order number to the following e-mail address: bonjour@quartierlibreparis.com. After reception of this e-mail, a return form to be printed will be sent to the e-mail address issuing the return request.
The package can then be returned to Quartier Libre. The product(s) must be returned in its original packaging, in its original condition, new, unworn, unwashed, with the original label, accompanied by the printed return form. The shipping address is :
Quartier Libre, 60 rue de Lisbonne, 75008 Paris, France.
The customer will have to join a copy of the invoice or any other element allowing to identify the order in question. Any complaints about the condition of the products (e.g. open or damaged package) must be notified immediately upon delivery.
In the absence of compliance by the Customer with these terms and conditions, in particular the conditions of return, Quartier Libre will not be able to proceed to the refund of the products concerned.

If the purchase has not been registered via the e-shop www.quartierlibreparis.com, it cannot be the subject of requests for refunds. If the purchase was made on the e-shop www.shopsovereigncollective.com, a request must be made to the site concerned.
Return costs are covered by Quartier Libre in Metropolitan France. The cost of return outside Metropolitan France will be borne by the Customer.
The refund of the returned item(s) is made after verification and registration of the return. Quartier Libre commits to process and refund any return within 10 working days.
Exchanges are not accepted by Quartier Libre. To make an exchange, it is advisable to get a refund for the product concerned and to place a standard order on the Site.

Article 8 - Compliance & After-Sales service
​
The photos are provided for illustrative purposes only. The Customer is invited to refer to the description of each product to know its precise characteristics. In case of doubt, or to obtain additional information, it is possible to contact customer service by e-mail at bonjour@quartierlibreparis.com.
It is possible that, following an Order, the Customer may receive a product previously returned by another person. It is specified that Quartier Libre only accepts the return of intact and unworn Products, these two conditions being checked before the returned Products are put back into stock.

Quartier Libre undertakes to refund the Customer for products which are apparently defective, deteriorated or damaged or which do not correspond to the Order. In this case, the Customer will have to report the situation in writing in detail and return the product(s) within 30 days of reception.
In any event, the Customer benefits from the legal guarantees of conformity and latent defects, in accordance with the legal dispositions in place :

Notes of articles L.211-4, L.211-5 and L.211-12 of the Consumer Code, and articles 1641 and 1648, first paragraph, of the Civil Code :
"Article L.211-4 of the French Consumer Code: the seller is required to deliver goods in conformity with the contract and is responsible for any defects of conformity present at the time of delivery. It is also liable for defects of conformity resulting from packaging, assembly instructions or installation when the latter has been charged to it by the contract or has been carried out under its responsibility. "
"Article L.211-5 of the Consumer Code: To be in conformity with the contract, the good must :
1° Be appropriate for the use usually expected of a similar good and, if necessary:
- correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model;
- present the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labelling ;
2° Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the knowledge of the seller and accepted by the latter. "
"Article 1641 of the Civil Code: The seller is bound by the guarantee on account of the hidden defects of the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have only given a lower price for it, if he had known about them. "

Article 9 - Guarantees & Responsibilities
​
Quartier Libre has, for all stages of access to the site, from the ordering process to the shipment of the package or subsequent services, only an obligation of means. Quartier Libre cannot be held responsible for all inconveniences or damages inherent to the use of the internet network, in particular a break in service, an external intrusion or the presence of computer viruses, or any fact qualified as force majeure, in accordance with the law and jurisprudence.
In the event of the occurrence of an event of force majeure, the party concerned must inform the other party within 15 days of the occurrence of this event, by registered letter with acknowledgement of receipt. Expressly, are considered as force majeure or fortuitous event, in addition to those usually retained by the jurisprudence of the French courts and tribunals, total or partial strikes, lock-outs, riots, boycotts or other actions of an industrial nature or commercial disputes, civil unrest, insurrection, war, bad weather, epidemic, blockage of means of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal or regulatory changes in forms of marketing, computer failure, blockage of telecommunications, including wired or wireless telecommunications networks, and any other event beyond the control of the parties that prevents the normal performance of the contractual relationship.
All obligations of the parties will be suspended for the duration of the force majeure event, without compensation. If the event of force majeure lasts for more than three months, the contract concerned may be terminated by operation of law without compensation for either party.

Article 10 - Intellectual & Industrial Property
​
We guarantee the authenticity of all products sold on the site.
All illustrations, images, characters, modes of presentation, graphics, characters, texts on the Site are and remain the exclusive property of Quartier Libre or of the holders of the said rights having granted Quartier Libre an exploitation right. Any reproduction, representation or use of said rights by a Customer will constitute a fault giving rise to legal proceedings.

Article 11 - Data processing & Liberties
​

The Customer is informed and accepts that his personal data may be collected on the Site and used by Quartier Libre which acts as data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter "General Data Protection Regulation" or "GDPR").
Quartier Libre is committed to protect and ensure the security and confidentiality of the Customer's personal data in accordance with the GDPR, notably by taking all useful precautions to prevent this data from being distorted, damaged or accessed by unauthorized third parties.
During navigation on the Site, information relating to the navigation of the user's terminal (computer, tablet, smartphone, etc.) may be recorded through files called "Cookies".
The user can modify his preferences in terms of cookies, through the browser software used.
In particular, the Customer's personal data may be transmitted to service providers and contractual partners who, as subcontractors within the meaning of the GDPR, intervene and contribute directly to the management of orders and for whom it is absolutely necessary to access the personal data provided by the Customer during the creation and use of his account (identity, postal address, telephone number, e-mail address). Subcontractors can only act on the instructions of Quartier Libre.

The personal data of Customers are collected for the following purposes:
- The management of orders and relations with the Customer;
- Customer's information relating to offers and commercial information related to the brand;
- The reinforcement and improvement of the communication of the Site and the brand by sending, in particular, newsletters and special offers based on the Customer's preferences noted on the Site;
- The proposal of offers corresponding to the preferences identified thanks to the navigation data (shopping cart, abandoned cart, purchase history);
- Improvement and personalization of the services offered to Customers; and
- Compliance with legal and regulatory obligations.

The Customer's personal data is kept only for the time strictly necessary for the purposes previously stated.
In accordance with the GDPR, the Customer has the right to access, rectify and oppose personal data concerning him (hereinafter the “Data Processing and Liberties”).

To exercise one or more of the Data Processing and Liberties, the Customer must send a request by email or by post to Quartier Libre Customer Service, by filling out the contact form located on the Site, by writing an email to bonjour@quartierlibreparis.com or by writing to the following address indicating his name, first name, e-mail address, customer references and terms: Quartier Libre, 60 rue de Lisbonne 75008 Paris. Each request must be signed and accompanied by a photocopy of an identity document bearing the Customer's signature and specify the reply address.
The response to the request made on the basis of one or more Data Processing and Liberties will be sent within 1 month of receipt of the request.
The Customer may communicate to Quartier Libre specific directives in which he or she defines the way in which he or she intends to exercise, after his or her death, the Data Processing and Liberties in accordance with the GDPR.
Quartier Libre may send Customers information relating relating to the articles of the brand and commercial offers by mail, email, sms, telephone or via all the web spaces animated by Quartier Libre on social networks, subject to prior acceptance.
The Customer has at any time the right to oppose at no cost to these commercial prospecting mailings by making the request to the customer service via an email to bonjour@quartierlibreparis.com.

Article 12 - Site Registration
​
The Customer's registration on the Site is validated by Quartier Libre after verification of the standard form completed by the Customer. The Customer receives an e-mail confirming registration.
When creating his Account, the Customer must ensure the accuracy and completeness of the data he provides. The Customer is required to always update his personal information. In the event of an error in the wording of the recipient's contact details, Quartier Libre cannot be held responsible for the impossibility of delivering Products.
By registering on the Site, the Customer declares and guarantees to Quartier Libre that he is of legal age and has the legal capacity to contract.
Quartier Libre may delete the Customer's Account at any time, for any reason, at its sole discretion.

Article 13 - Applicable Rights & Litigation
​
The contract formed by the acceptance of these Terms & Conditions is subject to French law. The language of this contract is English language. In case of dispute, the French courts will have exclusive jurisdiction.
